Special Education Services (SES) supports Local Education Agencies (LEAs) in providing clear, timely notice to parents and documenting their participation in decisions about a child’s special education. A copy of Alabama’s Special Education Rights explains the procedural safeguards available under IDEA; prior written notice explains a specific action the LEA proposes or refuses. These are distinct requirements.

Alabama Administrative Code, Chapter 290-8-9, including Rule 290-8-9-.08
Provide the procedural safeguards notice to parents at least once each school year and also upon initial referral or parent request for evaluation; upon receipt of the first state complaint and first due process complaint in that school year; when a disciplinary change of placement requires the notice; and upon parent request. Use the current Alabama Special Education Rights document rather than an archived copy.
Provide prior written notice a reasonable time before the LEA proposes or refuses to initiate or change identification, evaluation, educational placement, or the provision of a free appropriate public education (FAPE). The notice must describe the proposed or refused action, explain why, identify the information relied upon, describe other options considered and reasons rejected, and include the remaining required elements of §300.503(b).
Write notices in language understandable to the general public and provide them in the parent’s native language or other mode of communication unless clearly not feasible. Document any oral translation or other steps required to ensure that the parent understands the notice. Obtain informed parental consent when IDEA requires it; providing prior written notice is not a substitute for consent.
Maintain a record of the version and date of each notice, how it was delivered, language-access steps, and any consent obtained or refused. Offer parents assistance in locating the current safeguards document and explaining how each dispute-resolution option works.
Providing Special Education Rights only at an initial meeting and missing later required trigger points
Using a generic prior written notice that does not explain the LEA’s reasons and rejected options
Treating notice, an invitation to an IEP Team meeting, and parental consent as interchangeable
Failing to document language access or delivery of notices
